On September 8, 2020, SENACLAFT issued Due Diligence Guidelines aimed at the Free Trade Zones sector. According to SENACLAFT, the purpose of these Guidelines is to assist the Free Trade Zone sector (consisting of Free Trade Zones, direct users and indirect users) in performing client due diligence procedures.
The Guidelines are not applicable to the reporting entities and persons mentioned in Article 70 of Decree No. 379/018, i.e., those engaging in any of the following activities, who must apply the due diligence procedures established in the pertinent rules for their areas: (i) casinos sector; (ii) real estate sector; (iii) attorneys, notaries and accountants sector; (iv) auctioneers sector; (v) antiques, works of art and precious metals and stone dealers sector; and (vi) corporate and trust services providers.
